Adeseun Ogundoyin Poly Rectorship Crisis: Can a Legislator order Statutory Council to Reverse Decision?

The Governing Council of Adeseun Ogundoyin Polytechnic, Eruwa was reported to have reversed the earlier pronouncement of Dr. Akinteye O. Adewuyi (an indegene of Igboora) as the new Acting Rector; approving tenure elongation of the incumbent Mr. Peter Adejumo (indegene of Eruwa) on the order of the Hon. representing the constituency where the Institution is situated who also doubles as the Speaker, Oyo State House of Assembly, Hon. Debo Ogundoyin.

According to a reliable source close to the school, the decision was made on the order of the Oyo Speaker, Rt. Hon. Adebo Ogundoyin on Tuesday night.

The sudden dissolution of the school’s current management and the appointment of a new team to lead the Institution which was announced on Friday by the Chairman Governing Council, Professor Samuel Ogundiran had generated protest among the host community (Eruwa) especially the youths demanding explanations for unruly sacked of their Son as the Acting Rector, and replacement with the Igboora born Akinteye (despite from same Ibarapa origin).

But according to Prof. Ogundiran “the appointment of new Acting Rector is in accordance with the Conditions of Service for Nigeria Polytechnics as contained in National Board for Technical Education (NBTE), Chapter Ten Cap (e)” that acting appointment shall be for a period of six months in the first instance and could be reviewed for another final period of six months.

“I am delighted to inform you that the Governing Council of Adeseun Ogundoyin Polytechnic, Eruwa at its meeting held yesterday 10th September 2021 appointed Acting Rector, Bursar and Head of Works for the Institution.

“The appointment of Dr. Akinteye O. Adewuyi as the Acting Rector, Oladipo S. Abimbola as the Acting Bursar and Abeegunde O. Olatunde as the Acting Head of Works took immediate effect, while the incumbent acting Rector, Mr. Peter Adejumo’s tenure ended on 10th September 2021.”

There are several questions surrounding this embarrassing situation:

1. Can the Speaker, Oyo State House of Assembly act in Executive capacity of the Governor who is the Visitor to the Institution issue an order to reverse a Statutory Governing Council’s decision?

2. Can a Council decision be reversed on order of a Legislator without a statutory Council meeting?

If the answers are NO, then it puts a demining clause and passed Vote of No Confidence on the integrity of the Governing Council of Adeseun Ogundoyin Polytechnic, Eruwa under the Chairmanship of Prof. Ogundiran.
